This agreement (referred to throughout as the “Terms”) applies to all work that is undertaken by Thistle InfoTech.
By placing an order with Thistle InfoTech, you signify that:
- You are over the age of 18
- By law, you are capable of entering into binding contracts
- You have the authority to bind the company or organisation you represent (if you are placing an order on behalf of a company)
Orders and Quotations
Quotations from Thistle InfoTech are valid only if:
- They are in writing
- They are less that 28 days old
Upon receiving an order, Thistle InfoTech will issue an “Order Acknowledgement”, usually via e-mail. This acknowledgement is merely notification that your order has been received, and should not be construed to imply acceptance of your order.
If your order is accepted, you will receive an “Order Confirmation”, usually via e-mail. This forms a binding contract between the client and Thistle InfoTech. The only exception to this is in the event of their being a discrepancy between the service that was ordered and the service that was stated in the Order Confirmation.
If Thistle InfoTech is unable to supply the requested services, you may cancel the order and require a full refund.
Thistle InfoTech reserves the right to alter the specification of the service that will be provided. In this event such changes will be specified in the Order Confirmation. No major alterations will be made without prior agreement with the customer.
Payment Terms
The full amount due for the requested services will be shown on the Order Confirmation.
Payment of 50% of the full price shall be made before any work is carried out. This applies to all contracts unless specifically stated to the contrary.
Once the requested service has been delivered, the remainder of the full price must be paid. Should it be decided that the service is no longer required, the remainder of the full price must still be paid, since the service carried out was commissioned by the client. Failure to make payment in a timely fashion will result in legal proceedings if necessary.
Services that are delivered piece-by-piece over a period of time are subject to price adjustments.
Our Liability
Thistle InfoTech shall not be held responsible for any loss or expense incurred as a result of actions taken by the client or third parties.
Thistle InfoTech shall not be held responsible for any costs incurred as a result of failure to meet deadlines (if any)
In the unlikely event that the work carried out results in loss or expense to the client in question, the liability of Thistle InfoTech shall be limited to the original cost of the service that was provided.
Although every effort is made to ensure that prices and descriptions are accurate, errors and omissions can occur, and in this event the client is entitled to cancel the contract, regardless of whether or we have sent an Order Confirmation. In this event Thistle InfoTech’s liability shall be limited to the refund of any money you have paid.
Data Protection
All information that is submitted to us by clients for the purpose of receiving services is handled in accordance with Thistle InfoTech’s Privacy Statement, which can be viewed at http://www.thistleinfotech.com/privacy.html
Thistle InfoTech is based in the United Kingdom and as such complies with the Data Protection Act 1998. All data collected is stored in the United Kingdom.
It is the responsibility of the client to ensure that the data held by Thistle InfoTech remains up to date and accurate.
When using this website, the servers will automatically log information, such as your Internet Protocol (IP) Address, which is used to identify problems with our website, administration of our website, and to maintain our web servers. No personal identifiable data is collected automatically.
Governing Law
Contracts for the purchase of services provided by Thistle InfoTech shall be governed by the laws of England and Wales.
Changes to these Terms
Thistle InfoTech reserves the right to update or modify these Terms at any time. Clients will be notified of any changes at least 30 days before they take effect.
